  • hollywood criminal defense lawyersDriving Under the Influence (DUI). The most common alcohol-related offense, DUI can include DUI with a child in the vehicle. DUI is considered driving while under the influence of alcohol or any drug to the extent that one’s ability to drive is significantly impaired. If you fail a field sobriety test, you would be considered to be DUI.
  • Driving with an Unlawful Alcohol Concentration. In South Carolina, it is illegal to drive with a blood-alcohol concentration (BAC) higher than .08%, even if you are not impaired. The effect of these two laws taken together means that you can be impaired but not legally drunk, and legally drunk even if you are not impaired.
  • Felony DUI/DWI. Felony DUI is a third DUI offense, or any DUI offense where “great bodily injury or death” occurs because of the impaired driving.
  • Open container. South Carolina makes it illegal to drive with an open container of alcohol in the vehicle, even if you are not drinking from it.
  • Boating While Intoxicated (BWI). The same rules apply on the water as on the road. You cannot boat and drink any more than you can drive and drink. Felony BWI will be charged if you seriously injure or kill someone while operating your watercraft while intoxicated.

About Our Attorneys

Senior partner Douglas N. Truslow was born and raised in South Carolina and attended the University of South Carolina and U. of South Carolina Law. He has been practicing law since 1975, first as Assistant Solicitor for Richland and Kershaw Counties, and then in private practice. Mr. Truslow is licensed to practice in South Carolina, the U.S. District Court, and the U.S. 4th Circuit Court of Appeals.

Neal D. Truslow went into partnership with his father in 2009, after graduating from the University of South Carolina School of Law. Besides working at the firm, Neal serves in the South Carolina National Guard with the Office of the Judge Advocate General (JAG). He handles primarily criminal and DUI cases, as well as courts-martial proceedings and domestic relations. Neal recently graduated from the U.S. Army Command and General Staff Officer College.
